The inclusive Education is based on the appraisal of the diversity as element that enriches the learning teaching process and consequently favors the human integral development. We consider the concept of most extensive inclusive education than that of integration, is related to the same nature of the education to regulate and of the common school. The inclusive education implies that all the members of a community learn together independently of their personal, social or cultural conditions included those that present since a disability to talented and gifted children. It is a matter of a school that does not put requirements of entrance neither mechanisms of selection or discrimination of any type, to do really troops the rights to the education, to the equality of opportunities and to the participation. In the inclusive school all the students are benefited of a teaching adapted to their needs and not only the ones that present special educational needs. The step of an inclusive education to an inclusive company is not easy neither immediate and requires to be undertaken since all its complexity, with the same systemic vision that the concept of educational inclusion involves (Moliner, 2008:30). Because of it and because we believe that the inclusive education is possible, we present us the few incidence that in the Spanish educational Legislation has had since as educational we interest us for her. Without place to doubts the inclusive education is a current theme. Is intimately connected with the theme "Diversity" in all its aspects. Our worry arises of the processing "parcelled out" that is given to say diversity in the educational legislation in general. The objective of our work is double: In the first place we propose us to revise the Legislation and to locate and to analyze different experiences with the purpose to obtain a repository of good practices related to the processing of the diversity establishing some most minimum criteria of what should contain these "Good practices". Some experiences they will help us to determine up to what point has the inclusion in the operation of its educational centres. Since the moment in which be possible we will revise also the educational Legislation of the autonomous region of Catalonia. He fits to add that the autonomous region of Catalonia is on time of approving the Catalonian Law of Education with a strong one bets on the inclusive education.

Our investigation is of basic character, part of a theoretical framework and intends to increase the know-how on the matter. It will be carried out in base to existing documents of which the information related to the theme of interest will be extracted. Being supported in sources of documentary character should be helped of the data harvesting instruments that respond to the criteria of validity, credibility and discrimination, as minimum requirements to achieve a scientifically valid report. We consider it also as exploratory Investigation since is carried out with purpose of to emphasize the fundamental aspects of specific problems and to find the adequate procedures to devise a subsequent investigation. To establish the most minimum criterion of good practices we will include the contribution of some teachers of different educational centres

We can present conclusions in which belongs to the review of the Legislation consulted since 1970 to the current one of the year 2007. As for expectations, we present us to know in which situation is the development of the concept of inclusive education by the one that wager, keeping in mind experiences carried out in the context of Spain keeping in mind its particularities. With it we present us in the future to experience the proposal of a code of good valid practices for different types of educational institution.
